This is the deal between you and me. Use FitMatch and you're agreeing to it. If you're not up for that, don't use the app. No hard feelings.
I've kept it in plain English wherever I can. A few sections near the end have to be written in lawyer language, so I've put a plain summary above each one.
FitMatch is for adults. By using it you're confirming you're 18 or older, that you're allowed to agree to this, and that you haven't been kicked off before.
Keep your password to yourself. Anything done through your account is treated as done by you.
Be who you say you are. Your real name, photos that are actually of you, honest answers about how you train. Someone's going to meet you at a gym off the back of this. Pretending to be someone else isn't a small thing, and it'll get you removed.
One person, one account.
FitMatch introduces you to people who train where you train, on the days you train, toward the things you're training for. That's the whole job.
I don't check anyone out. No background checks, no ID verification, no screening of any kind. I have no way of knowing whether someone is who their profile says they are.
A FitMatch profile isn't a reference and it isn't a safety guarantee. Everyone on here is a stranger. Treat them like one.
The point of FitMatch is that you actually meet and train together. Meeting strangers carries real risk, and that risk is yours to carry.
Things worth doing, every time:
What happens between you and another member, in the app or at the gym, is between the two of you. I'm not there, I'm not supervising it, and I can't take responsibility for it.

That list isn't exhaustive. If you're making FitMatch worse or less safe for other people, you'll be removed whether or not I thought to write it down.
You own everything you post. Nothing here takes that away.
What you're giving me is permission to store and display it so the app can work: to show your profile to other members, deliver your messages, play your videos in the feed. That's the extent of it. When you delete something, or delete your account, that permission ends, apart from backup copies that age out and anything I'm required to keep for safety or legal reasons.
Post things you actually have the right to post. I can take down anything that breaks these rules, and I won't always warn you first.
Every profile and every conversation has Block and Report. Blocking someone cuts them off completely. They can't message you and they won't see you in the app.
I read every report and act on it within 24 hours. Depending on what I find, that means removing content, a warning, a suspension, or removing someone for good.

If someone's in immediate danger, call emergency services first. I'm one person with a laptop. I'm not an emergency service and I can't respond like one.
You can delete your account whenever you like, in Settings → Delete Account. It's permanent.
I can suspend or remove your account if you break these rules, if I think you're a risk to other members, or if the law makes me. And if I ever have to shut FitMatch down, I'll give you as much notice as I can.
In short: FitMatch is a beta app built by one person. It'll have bugs. I can't promise it'll be up, or that you'll find a training partner, or that anyone is who they claim to be.
FitMatch is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. I do not warrant that the app will be uninterrupted, secure, or error-free, or that any defect will be corrected. I do not warrant that you will find a training partner, that any member is who they represent themselves to be, or that any interaction arranged through FitMatch will be safe, lawful, or satisfactory.
In short: if something goes wrong between you and another member, that's not something I can be held financially responsible for. FitMatch is free, and there's a cap on what you could claim from me.
To the fullest extent permitted by law, FitMatch and its operator will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill or other intangible losses, arising out of or relating to your use of the app. This specifically includes any injury, loss, damage or harm arising from your interactions with other members, whether online or in person.
To the fullest extent permitted by law, total aggregate liability to you for all claims relating to FitMatch will not exceed the greater of the amount you have paid in the twelve months before the claim, or one hundred United States dollars (USD $100).
Some places don't allow these exclusions. Where that's true, the limits above apply only as far as the law there permits.
In short: if your behaviour on FitMatch gets me sued, that's on you, not me.
You agree to indemnify and hold harmless FitMatch and its operator from any claim, demand, loss, liability or expense (including reasonable legal fees) arising out of your use of the app, your content, your interactions with other members, or your breach of these terms.
In short: Maryland law, Maryland courts.
These terms are governed by the laws of the State of Maryland, United States, without regard to its conflict of law rules. Any dispute arising from these terms or your use of FitMatch will be brought exclusively in the state or federal courts located in Maryland, and you consent to the jurisdiction of those courts.
The date at the top moves. If it's a change that actually matters to you, I'll tell you in the app or by email before it takes effect. Carrying on using FitMatch after that means you're fine with the new version.
If any part of these terms turns out to be unenforceable, the rest still stands. If I don't enforce something once, that doesn't mean I've given up the right to. These terms and the Privacy Policy are the whole agreement between us about FitMatch.
